Beyond Arctic terms & conditions

1. General terms
By participating in or booking Beyond Arctic programs or any related products or services you agree to the terms and conditions set out below. The prices and services offered by Beyond Arctic are described in the specific program descriptions for each service separately. Language used during all our services is English.
2. Booking and confirmation
Once Beyond Arctic Oy has confirmed your booking the contract is made between Beyond Arctic and you. On Internet bookings, you will receive confirmation of your booking to your email.
3. Cancellations
In case of cancellation, you need to contact Beyond Arctic as soon as possible via email or phone. We will cancel your booking as we receive your request by following these cancellation terms:
7 days prior to program – Full refund
2-6 days prior to program – 50 % of the reservation held as a charge.
0 - 24 hours prior to program – 100% of the reservation held as a charge
Group tours (9 or more persons)
21 days prior to program - Full refund
7-20 days prior to program - 50% of the reservation held as a charge.
6 days or less prior to program - No refund
Private holiday packages
30 days or more prior to program - Full refund, except 200€ booking fee held as a charge.
15-29 days prior to program - 50% of the reservation held as a charge.
14 days or less prior to program - No refund
Cancellation Due to Sickness
In the event of cancellation due to sickness, our normal cancellation policy will apply. We strongly recommend that you take out valid and comprehensive travel insurance that covers cancellation due to illness or other unforeseen circumstances. It is the traveller’s responsibility to ensure that the insurance provides adequate coverage for the trip and any applicable cancellation costs.
Beyond Arctic has the right to cancel the program if the minimum count of participants specified in excursion description is not reached. If activity can't be organized because of limited snow conditions, Beyond Arctic has the right to modify the program and adapt it with the current weather and snow conditions.
4. Payment
We accept most common credit/debit cards and cash money (euro). The prices given by Beyond Arctic include VAT according to the taxation laws of Finland. Beyond Arctic reserves the right to change the prices if any extra costs occur.
5. Liability and Personal Travel Insurance
Beyond Arctic complies with applicable health and safety laws, regulations and standards in Finland and follows appropriate safety procedures and guidelines when providing its programmes and services.
Some of Beyond Arctic’s programmes may take place in remote areas and away from populated centres, where access to emergency services and medical assistance may be limited. Participants acknowledge that participation in such activities involves inherent risks, including slips, falls, accidents, injuries and other incidents arising from the terrain, weather conditions or other circumstances.
Participants are responsible for exercising reasonable care, following all safety instructions provided by Beyond Arctic and its guides, and informing the guide of any circumstances that may affect their ability to participate safely.
Beyond Arctic shall be liable for personal injury, loss or damage caused by the negligence or willful misconduct of Beyond Arctic or its employees, or by defective equipment provided by Beyond Arctic, to the extent required under applicable law.
Beyond Arctic shall not be liable for accidents, slips, falls, injuries, loss or damage arising from the inherent risks of the activity or from the participant’s own actions, negligence or failure to follow safety instructions, except to the extent that such liability cannot be excluded or limited under applicable law.
Participants are strongly recommended to have valid and comprehensive travel insurance covering, where applicable, medical expenses, accidents, emergency assistance, evacuation, personal belongings and cancellation costs.
Nothing in these Terms and Conditions shall exclude or limit any liability that cannot lawfully be excluded or limited under applicable law.
6. Liability insurance
Beyond Arctic has general third-party liability insurance for bodily injuries and damaged property. The terms and conditions of liability insurance are conducted by LähiTapiola Oy.
7. Programme Changes and Safety
Beyond Arctic reserves the right to modify or reschedule a planned programme where necessary for operational, weather-related or safety reasons. Due to adverse weather conditions, extreme cold or other circumstances affecting the safety of participants or staff, Beyond Arctic may cancel a programme. In the event that Beyond Arctic cancels a programme, the reservation will be fully refunded.
Beyond Arctic also reserves the right to discontinue or refuse participation in a programme if a participant is considered to pose a potential danger to themselves, other participants or staff, or if their behaviour may compromise the safe operation of the programme. Participation in our programmes while under the influence of alcohol or drugs is strictly prohibited.
If a participant is unwell or is physically unable to safely participate in a programme, Beyond Arctic may refuse or discontinue their participation. Participants are responsible for informing Beyond Arctic in advance of any relevant physical limitations or other circumstances that may affect their ability to participate safely.
During some adventures and tours, open fires, oil lamps and other sources of heat or hot objects may be used. Participants acknowledge that these activities involve inherent risks, including the risk of burns, fire or damage to personal belongings. Participants are expected to follow all safety instructions provided by Beyond Arctic and its guides.
Participants acknowledge that some of the activities and services provided or arranged by Beyond Arctic, including services provided by local partners, may involve inherent risks to health and safety. By participating in a programme, participants acknowledge these risks and agree to follow all safety instructions and guidance provided by Beyond Arctic, its guides and local partners.
Nothing in these Terms and Conditions shall exclude or limit any liability that cannot lawfully be excluded or limited under applicable law.
8. Responsibility
Beyond Arctic shall not be liable for the loss of or damage to participants’ personal belongings or valuables during the programmes, except to the extent that such liability cannot be excluded or limited under applicable law. Participants are responsible for taking reasonable care of their personal belongings and valuables throughout the programme.
Participants are responsible for any equipment provided or lent to them by Beyond Arctic during the programme and must use such equipment with reasonable care and in accordance with the instructions provided.
If any equipment is lost or damaged due to a participant’s intentional act, negligence or misuse, Beyond Arctic reserves the right to charge the participant for the reasonable costs of repairing or replacing the equipment.
9. Partner tours
Beyond Arctic also operates as a destination management organisation, and some of the activities offered on our website are organised and provided by trusted local partners. In such cases, Beyond Arctic acts as a selling agent for the activity, while the actual service is provided by the respective local supplier.
Some third-party activities are subject to separate cancellation terms and conditions established by the local supplier. Where applicable, these specific cancellation terms shall apply instead of the general cancellation terms set out in these Terms and Conditions. This may apply, for example, to husky safaris, snowmobile activities and ice climbing activities.
Beyond Arctic requires its local partners to comply with applicable health and safety laws, regulations and standards in Finland. However, as the actual services are provided by independent local suppliers, Beyond Arctic shall not be liable for personal injury, loss or damage arising from accidents or incidents occurring during the provision of services by such suppliers, except to the extent that such liability cannot be excluded or limited under applicable law.
10. Snowmobiles in tours
Snowmobile driver is held liable for any damages caused to the vehicle. Personal self-liability in snowmobile safaris and electric snowmobile safaris is max. 990 €/person/snowmobile/case of accident. Payment is to be paid at the spot in safari operators house (Safartica Ltd.) by cash or credit card. The driver of the snowmobile must be at least 18 years of age and in possession of a valid driver’s license in Finland.
Finnish law prohibits driving a motor vehicle in under the influence of alcohol or any other intoxicating drug. As the responsible safari organizer, Beyond Arctic or snowmobile tour operator reserves the right to change the routing, schedules, duration or the content of the program, if necessary, due to prevailing weather conditions, safety reasons and the comfort of the participants.
Beyond Arctic or snowmobile tour operator also reserves the right to interrupt the safari if a participant is seen as a potential danger to him/herself or to others or is in poor health.
In case of extreme temperature (below -20 °C or other extreme weather condition) Snowmobile operator keeps the
right to transfer children by car to the locations or deny participation due to safety reasons. In case Snowmobile operator cancels client’s participation to the program due to extreme weather, client is entitled for a full refund.
11. Photos and videos
During Beyond Arctic programmes, our guides may occasionally take photographs and videos of the surrounding nature, participants and activities.
Beyond Arctic reserves the right to use such photographs and videos for marketing, promotional and other business purposes, subject to applicable laws and regulations.
Any person who does not wish to be photographed or filmed, or who does not wish photographs or videos depicting them to be used for marketing or promotional purposes, may notify Beyond Arctic by email at contact@beyondarctic.com.
We will make reasonable efforts to respect such requests.
12. Force Majeure
Beyond Arctic shall not be liable for any loss, damage, delay or failure to perform its obligations resulting from unavoidable and extraordinary circumstances beyond its reasonable control, which could not reasonably have been foreseen or avoided.
Such circumstances may include, but are not limited to, natural disasters, war, armed conflict, airspace restrictions, earthquakes, floods, extreme weather conditions, security threats such as terrorism, risks to human health, pandemics, outbreaks of serious disease, government restrictions, strikes or other extraordinary circumstances that prevent or materially affect the provision of the services.
In such circumstances, Beyond Arctic shall be entitled to suspend, modify or cancel the affected services without being liable for any resulting loss or additional costs, to the extent permitted by applicable law.
13. Applicable Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of Finland.
The Finnish courts shall have exclusive jurisdiction over any dispute, controversy or claim arising out of or in connection with these Terms and Conditions.
The District Court of Lapland (in Finnish: Lapin käräjäoikeus), located in Rovaniemi, Finland, shall be the court of first instance.
14. Severability
If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable, in whole or in part, such provision shall, to the extent of its invalidity, illegality, or unenforceability, be deemed severed from these Terms and Conditions. The remaining provisions shall remain valid and enforceable and continue in full force and effect.
15. Changes to these terms & conditions
Beyond Arctic can change these terms and conditions at any time without further notice.
